1. Who Can Use the Services

You must be at least 18 years old to use the Services or to send us your information.

2. What National House Search Is — and Is Not

• National House Search is an online platform that helps people find and compare new-construction homes from many builders, and that provides websites and marketing tools to licensed real estate agents.
• We are not a home builder. We are not the official website of any builder shown on our site, and no builder endorses our site, unless we clearly say so.
• Builder names, logos, trademarks, photos and floor plans belong to their owners. We use builder names only to identify their homes and communities.
• We are not a mortgage lender and do not make loans.
• Websites on our platform that carry a real estate agent’s name and branding are run by that independent agent using our technology. The agent is not our employee.

3. Real Estate Services

Information on our site is general information. Using the site does not create an agency or client relationship with anyone. National House Search is not a real estate brokerage and does not represent buyers or sellers. Real estate services are provided by independent, licensed real estate agents, such as the agent whose site you used, who are responsible for their own services. A buyer representation relationship exists only under a separate written agreement that you sign. How a buyer’s agent is paid, and by whom, is stated in that written agreement.

4. Information on Our Site — Please Verify Everything

We work to keep information current, but builder information changes often and can contain mistakes. On our site and in our videos, emails, texts and social media posts:

• Prices, incentives, interest rates, financing programs, availability, and HOA information can change at any time without notice. “Call for pricing” means the builder has not published a price.
• Floor plans, square footage, dimensions, features and finishes are approximate and may change. Homes as built may differ.
• Photos, renderings, maps, virtual tours and videos are for illustration. They may show model homes, upgrades, decorations or furniture that are not included. Our videos may use a computer-generated voice and photos that have been edited or cropped.
• Descriptions and answers to common questions on our pages may be written or checked with the help of AI tools, and may contain mistakes.
• Information about schools, distances, nearby businesses, parks and amenities is for general reference only. It can change; for example, school assignments are set by the school district.

Always confirm details directly with the builder before making a decision. Your signed purchase contract with the builder controls over anything on our site. Nothing in the Services is an offer to sell a home or an offer of credit. Any interest rate or financing program is subject to the lender’s approval, your qualification and the program’s rules.

5. Calls, Texts, and Emails

If you give us your phone number and check the box agreeing to calls and texts, you agree that National House Search, the agent whose site you used (if any), and licensed real estate professionals working with us may call and text you at that number about your home search, including with marketing messages. These calls and texts may be sent using automated technology. If you leave the box unchecked, we will not text you. Your consent is not a condition of buying any home, property, product or service. You can withdraw consent at any time by replying STOP to any text or by telling us. We aim to contact you only between 8 a.m. and 8 p.m. in your local time. If you give us your email address, we may email you; every marketing email includes an unsubscribe link.

6. Text Message Terms

• Program: National House Search text messages about your home search, appointment reminders, builder incentive information and offers.
• Frequency: Message frequency varies.
• Cost: Message and data rates may apply.
• Opt out: Reply STOP to cancel at any time. You will receive one final message confirming you are unsubscribed.
• Help: Reply HELP, call 561-704-0091, or email nationalhousesearch@gmail.com.
• Mobile carriers are not liable for delayed or undelivered messages.
• Our Privacy Policy explains how we handle your information. We never share your mobile number or text consent with third parties for their marketing.

7. AI Tools and Assistant

Some content on our site, such as community, floor plan and home descriptions, is written with the help of AI tools and reviewed by our team. Some replies on our social media pages may come from an automated AI assistant. AI content and answers can be incomplete or wrong and are not professional, legal, tax or financial advice. Confirm anything important with a person by calling 561-704-0091. Do not share sensitive personal information with the AI assistant.

8. Agent Partnership Program

This section applies to licensed real estate agents who sign up for the National House Search Agent Partnership Program (the “Program”), on the free or the paid plan. If you join the Program, you agree to this section in addition to the rest of these Terms.

Who can join

• You must hold an active real estate license in good standing and be affiliated with a licensed brokerage.
• Tell us right away if your license or brokerage changes, lapses or is suspended. We may pause your account until it is fixed.

What the Program includes

Free plan:your own agent page on NationalHouseSearch.com featuring a community, a buyer lead form, buyer leads in your dashboard, your buyer’s guide, and access to our photo, video and social media content libraries.

Paid plan: everything in the free plan, plus a full branded website on your own subdomain or web address, with the communities you choose to show, a blog, search engine settings, Google Analytics, your own scheduling calendar, and delivery of leads to your own GoHighLevel account.

Which communities and builders your site can show is set by us. We may add, change or remove features and communities at any time.

No leads, sales, or income are guaranteed

We provide a marketing system. We do not promise any number of leads, buyers, sales, search rankings or income. Your results depend on your own work and on the market. There is no exclusivity: you may work with any builder, buyer or brokerage you choose.

Commissions and builder bonuses

National House Search does not pay commissions or bonuses. Any commission or bonus on the sale of a new home is paid by the builder or through the transaction, under that builder’s program in effect at the time, and only as the builder’s written terms and your brokerage allow. Builder programs and amounts change often. Always confirm the current terms with the builder in writing before you rely on them.

Paid plans

• Paid plans are arranged directly with us. The price, billing schedule and any promotional terms are the ones we confirm with you in writing when you upgrade.
• If a payment is not made, we may suspend your branded website until it is. Your settings and content are kept and return when your account is brought up to date.
• If you move to the free plan, your full website stops showing and your free agent page stays.

Your responsibilities

• Follow all laws and rules that apply to you, including real estate license law, your brokerage’s policies, real estate advertising rules (such as showing your brokerage’s name where required), fair housing laws, and laws on calls, texts and emails.
• Contact leads only as the law and their consent allow. You are responsible for your own calls, texts and emails to them.
• Keep your login private. You are responsible for activity on your account.
• Make sure everything you add to your page or website, including blog posts, photos and videos, is true and that you have the right to use it.
• If you use your own web address, you are responsible for keeping it registered.

Using our materials

While you are in the Program, you may use the photos, videos, guides and other materials we provide only to market homes and communities listed on National House Search, and only in the way we allow. You may not sell, sublicense or give them to anyone else. Some materials belong to builders or other owners and may carry extra limits. When you leave the Program, you must stop using them in any new marketing.

Your content

You keep ownership of your name, photo, logo and content. You give us permission to display them on your branded page or website and to use them to provide the Program while you are a member. We may remove content that breaks these Terms.

Ending your membership

You may leave the Program at any time by emailing nationalhousesearch@gmail.com. We may suspend or end your membership if you break these Terms, misuse leads or materials, or your license is not active. When your membership ends, your branded page or website and your access to Program tools are removed.

Independent relationship

“Partnership” is the name of the Program, not a legal partnership. You are an independent licensee. Nothing in the Program makes you our employee, agent or joint venturer, makes us part of your brokerage, or creates a brokerage relationship or referral fee agreement between us.

9. Rules for Using the Services

You agree not to:

• Copy, scrape or collect content or listings from the Services using bots, spiders or other automated tools.
• Use our content to build a competing service or to train artificial intelligence models.
• Submit false information, or someone else’s information without their permission.
• Post anything unlawful, harassing, hateful or misleading.
• Interfere with, hack or overload the Services, or try to get around security features.

10. Our Content

The Services, including our text, design, videos, graphics and logo, are owned by National House Search or the companies that license them to us, and are protected by copyright and trademark laws. You may view and share our pages for your personal, non-commercial use. Any other use needs our written permission.

11. What You Send Us

You are responsible for the information, comments and feedback you send us. You give us permission to use feedback and comments to run and improve the Services. We may remove anything that breaks these Terms.

12. Other Websites and Services

The Services link to websites and tools we do not control, such as builder websites, lenders, YouTube, social media and scheduling tools. We are not responsible for their content, accuracy or privacy practices. Your use of them is at your own risk and under their terms.

13. Fair Housing

National House Search supports the Fair Housing Act and equal housing opportunity. We do not discriminate on the basis of race, color, religion, sex, disability, familial status or national origin, or on any other basis protected by federal, state or local law. To report housing discrimination, contact the U.S. Department of Housing and Urban Development at www.hud.gov/fairhousing or 1-800-669-9777.

14. Accessibility

15. Copyright Complaints

If you believe something on the Services infringes your copyright, email nationalhousesearch@gmail.com with: your contact information; a description of the copyrighted work; the web address where the material appears; a statement that you believe in good faith the use is not authorized; a statement, under penalty of perjury, that your notice is accurate and that you are the owner or are authorized to act for the owner; and your physical or electronic signature.

16. Disclaimers

THE SERVICES AND ALL INFORMATION IN THEM ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF ACCURACY, COMPLETENESS, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. WE DO NOT PROMISE THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE.

17. Limitation of Liability

TO THE FULLEST EXTENT ALLOWED BY LAW, NATIONAL HOUSE SEARCH AND ITS OWNERS, EMPLOYEES AND PARTNERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA OR OPPORTUNITY, ARISING FROM YOUR USE OF THE SERVICES OR YOUR RELIANCE ON ANY INFORMATION IN THEM. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SERVICES WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100).

18. Indemnity

You agree to defend and hold harmless National House Search and its owners, employees and partners from any claims, losses and costs (including reasonable attorneys’ fees) that result from your breaking these Terms or misusing the Services.

19. Governing Law and Where Disputes Are Decided

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-law rules. Any dispute about the Services or these Terms will be decided only in the state or federal courts located in Palm Beach County, Florida, and you and we agree to those courts’ jurisdiction.

20. Changes and Termination

We may update these Terms at any time by posting a new version with a new “Last updated” date. Using the Services after an update means you accept the new Terms. We may suspend or end access to the Services for anyone who breaks these Terms.

21. General

If any part of these Terms is found unenforceable, the rest stays in effect. Our not enforcing a part of these Terms is not a waiver. These Terms and our Privacy Policy are the entire agreement between you and us about the Services.
